ANDHealth Pty Ltd (ABN 32 617 835 542) offers programs, services, activities and events, designed specifically to support entrepreneurs and innovators working in the fields of in digital and connected health and medical technologies, products and services.

ANDHealth’s purpose is to accelerate the commercialisation and uptake of evidence-based digital and connected health and medical technologies, products and services.  In order to achieve our purpose, ANDHealth engages in and delivers a broad range of activities, events, program and initiatives , including wide reaching industry development and advocacy activities, both across Australia and internationally.

In order to provide these activities and services to our participating individuals, companies and partner organisations (including State and Federal Governments), to support the overarching growth and support of Australia’s digital and connected health and medical technologies, products and services sector, and in consideration for the services provided, which are provided either free or on a significantly discounted basis, we request that all participating companies allow us to utilise their non-confidential application data in our activities aligned to the pursuit of our purpose.

This Data Collection Statement focuses on ANDHealth’s responsible use of data and has been updated to include provisions regarding artificial intelligence (AI). As part of our commitment to transparency and ethical data practices, any data utilised in AI-based activities will comply with strict guidelines ensuring alignment with privacy principles and industry standards.

As a technology-forward organisation, ANDHealth recognises that AI tools offer us the ability to dramatically increase our impact and ability to support our sector. We are committed to using AI technologies exclusively to enhance our ability to achieve our purpose. Our AI policy states that we will only utilise external AI tools which provide enterprise-grade security protections and which do not use your data to train their algorithms. Where ANDHealth opts to develop in-house AI tools to improve our ability to support you and the broader sector, best practice processes will be deployed in order to anonymise and secure your data.

All AI tools employed in the analysis of participant and company data will be subject to robust oversight mechanisms, will be applied ethically and only deployed in ways that preserve the confidentiality of commercially sensitive data. Should you have specific concerns about AI use related to your application data, you are encouraged to reach out to us for clarification or to request additional confidentiality measures.

The below terms and conditions (i.e. 'the fine print’) outlines how we use your application data.  However, we thought it might be useful for us to first set out our values and general principles in dealing with the data we collect.

1. The majority of our programs, activities, events and services are supported by public funding agencies which require us to collect and disclose high level data about our attendees as a requirement for funding. These requirements are not optional for us and so all participants need to agree to this requirement.
2. As a non-profit organisation, the majority of ANDHealth activities are provided to participants either free of charge or at substantial discounts (often below cost). This means that we are continually seeking new sources of funding to support the sector and the data we collect is critical to our ability to do this.
3. We believe that all data is valuable so we do our very best to take care of it by using appropriately protected enterprise-grade software platforms and restricting who can access it.
4. We use the data we collect on companies for good, including providing otherwise unknown summaries on digital health activity across Australia (in anonymised and aggregated form), identifying potential collaborations between companies for mutual benefit and identifying companies we should reach out to when we have potential commercial opportunities with ANDHealth subsidiaries, related parties and partner organisations.
5. ANDHealth recognises that AI tools offer us the ability to dramatically increase our impact and ability to support our sector. We are committed to using AI technologies exclusively to enhance our ability to achieve our purpose. As such we may utilise appropriate AI models to enhance our services, activities and ultimately increase our impact.
6. We respect the confidentiality of commercially sensitive data. We seek to assess and track companies on their clinical indication, technology type, location, size, capital raised, jobs created, commercial and clinical pilots and clinical publications. Our industry reports are anonymised, and our case studies only ever reference high level publicly available information (such as your company name, key contacts, company profile and location). If you are unsure about data that you enter in your application, please identify any information that should be held by us in confidence as confidential.

Data Collection Terms, and Conditions

The ANDHealth Event, Program or Service you have applied for or to attend (“ANDHealth Activity”) is offered by ANDHealth of Level 2, 99 William Street, Melbourne VIC 3000 Australia. In these terms and conditions, “you” means the individual who has submitted the request to attend the ANDHealth Activity and, where you submitted that application as an employee or contractor of a body corporate or other entity, “you” will also include that body corporate or other entity that employs or engages the individual who submitted the request.

1. ANDHealth (“we”, “us”, or “our”) is committed to protecting your privacy and ensuring that your personal information is handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This document outlines how we collect, use, disclose, and protect your personal information, including when using Artificial Intelligence (AI) systems.
2. ANDHealth may use the data submitted by applicants for activities which are aligned to its purpose of accelerating the commercialisation and uptake of evidence-base digital and connected health and medical technologies, products and services, including the development of industry intelligence and analysis, publication of statistics regarding industry development, and identifying companies with specific clinical or technology foci, facilitating partnerships, collaboration and/or investment, information collected automatically (e.g., usage data, device information) or interacting with AI-powered systems (Data Utilisation).
3. These terms and conditions solely relate to ANDHealth’s use of the data and other information that you submitted as part of your application to attend the ANDHealth Activity or which you otherwise provide to ANDHealth at or in connection with attending the ANDHealth Activity (“Submitted Data”). Additional terms and conditions may apply if your application to attend ay ANDHealth Activity is accepted by ANDHealth (including a requirement to pay any fees to attend that Program, if applicable). Submitted Data that you would like ANDHealth to keep confidential must be marked as 'confidential' or 'commercial in confidence' (“Confidential Data”).
4. This agreement (as represented by these terms and conditions) between you and ANDHealth is entered into in consideration of the parties incurring obligations and giving rights under this agreement and for other valuable consideration.
5. In exchange for ANDHealth considering your application or registration to attend the ANDHealth Activity, you agree that  ANDHealth may utilise the Submitted Data for its own internal business purposes, including but not limited to the development of industry intelligence and analysis, publication of statistics regarding industry development, identifying companies with specific clinical or technology foci, facilitating partnerships, collaboration and/or investment, identifying companies which may benefit from opportunities within the ANDHealth network, and/or for the purpose of reporting or disclosing to third parties the Submitted Data. Where you have included Confidential Data in your application, this Confidential Data will not be disclosed by ANDHealth, except as required to meet ANDHealth’s own legal obligations. To the extent permitted by law, if ANDHealth is legally required to disclose your Confidential Data, ANDHealth will take reasonable steps to ensure that the recipient(s) of that Confidential Data keep that data confidential. Public disclosure of Submitted Data will be in an aggregated or de-identified form, unless consent is first requested from you.
6. ANDHealth recognises that AI tools offer us the ability to dramatically increase our impact and ability to support our sector. We are committed to using appropriate, enterprise-grade AI technologies exclusively to enhance our ability to achieve our purpose. As such we may utilise appropriate AI models to enhance our services, activities and ultimately increase our impact. Where such AI tools are utilised, your data will not be used to train external third party models and will only be used in the context of ANDHealth enhancing its ability to deliver the ANDHealth Activity.
7. By submitting your application to attend the ANDHealth Activity, you grant to ANDHealth a non-exclusive, perpetual, irrevocable, royalty-free, worldwide licence (with the right to grant sub-licenses through multiple tiers) to use, reproduce and disclose the Submitted Data, but excluding any Confidential Data, for the purposes described in clause 4. This licence will not extend to allowing ANDHealth to commercialise any business ideas, patents, trade secrets or confidential information disclosed by you as part of the Submitted Data.  
8. By submitting your application to attend the ANDHealth Activity, you represent and warrant to  ANDHealth that: (a) you are authorised to provide the Submitted Data to  ANDHealth and to grant the licence to the Submitted Data set out in clause 5; and (b) ANDHealth's use, reproduction and disclosure of that Submitted Data in accordance with that licence will not infringe the copyright or other intellectual property rights of any third party.
9. To the maximum extent permitted by law, including the Australian Consumer Law, in no event will ANDHealth be liable for any direct, indirect or consequential loss, damage or expense (irrespective of the manner in which it occurs) which may be suffered or incurred by you arising out of or in connection with the use, reproduction and disclosure of Submitted Data by  ANDHealth or any other parties or by  ANDHealth's acceptance or rejection of your application to attend the Program.
10. Data Breaches

    If we become aware of a data breach that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by law.
11. Changes to These Terms

    We may update these Terms and Conditions from time to time. The latest version will always be available on our website (www.andhealth.com.au/privacy-policy). We encourage you to review this document regularly.
12. These terms and conditions are governed by the law of the State of Victoria, Australia and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in the State of Victoria, Australia.
